general terms and conditions…

These general conditions for promotions and competitions apply to competitions and other promotional activities organised by Mercantile International Limited and/or its subsidiaries or its affiliated companies. In addition, each competition and/or other promotion is subject to specific terms and conditions mentioned in the specific competition rules.

Promoter. The promoter is Mercantile International Limited of 6th Floor, Becket House, 36 Old Jewry London, EC2R 8DD, United Kingdom or such of its subsidiaries or its affiliates as may be named in the specific conditions (hereinafter “Company”).  Mercantile International Limited is an Introducer Appointed Representative of Agincourt Financial Limited who is authorised and regulated in the United Kingdom by the Financial Conduct Authority (FCA) with Firm Reference Number.: 197236. Company Registration No. 09929738 in England & Wales. “Mercantile Circle” is a trading name of the Mercantile International Limited.

Eligibility and Limitations. This promotion is open to residents of the United Kingdom aged 25 years or over at the time of valid entry into the promotion in accordance with these terms and conditions and any specific conditions relating to the relevant promotion. Employees of the Company, their close relatives and anyone otherwise connected with the Company are not eligible to participate. The promotion cannot be used in conjunction with any other offer. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.

Participation. There is no entry fee and no purchase necessary to enter this promotion. By entering this promotion, a participant is indicating his/her agreement to be bound by these terms and conditions.

Disclaimer. The Company cannot accept any responsibility for entries not received for any reason whatsoever.

Publicity. All participants and the winner(s) of any prize grant the Company permission to use their names, location, characters, photographs, in connection with this promotion, other promotional offers offered by the Company, and in relation to the announcement of the winner through all media, including radio, television and internet and waive any claims to royalty, right, or remuneration for such use.

Release. By submitting an entry into the promotion, each participant and winner waives any and all claims of liability against the Company and its employees, for any personal injury or loss which may occur from the conduct of, or participation in, the promotion, or from the use of any prize.

Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes. Prizes are not transferrable or redeemable for cash.

Decisions. The Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the giveaway, or obtained winner status using fraudulent means. Further, the Company will resolve any disputes, conflicting claims or ambiguities concerning the rules and the Company’s decisions concerning such disputes shall be final. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion.

Right to cancel. The Company reserves the right to cancel or amend the promotion and these terms and conditions without notice at any time without any obligation to compensate any damages on behalf of the participant. Any changes to the competition will be notified to participants as soon as possible by the Company.

Prize & Delivery. The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and the Company reserves the right to substitute any prize with another of equivalent value without giving notice. The Company is not responsible for any visible or hidden defects in the prize nor for any damage during delivery (shipping) of the prize.  Where delivery of the prize is undertaken by a third party, the Company is not responsible for the delivery of the prize.

Miscellaneous. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of this giveaway. Written copies of these rules are available during normal business hours at the business offices of Mercantile International Limited and by mail upon written request with a stamped, self-addressed return envelope. All entries become the property of the Company and will not be returned.

Data Protection: The participant consents to the processing of personal data in connection with participation in the competition. The Company may add the personal information to its database, which is confidential and will be treated in accordance with the Data Protection Act. Personal information may be used to execute the competition. In this context, the Company is entitled to provide personal data to third parties involved in the relevant competition (including suppliers, advertisers, sponsors and/or producers). Moreover, the participant gives permission to the Company to keep him/her informed of the products and/or services of the Company, its partners (including sponsors, manufacturers and advertisers) and carefully selected companies. Where possible, the Company requires that third parties who handle or obtain personal information as service providers acknowledge the confidentiality of this information, undertake to respect any individual’s right to privacy and comply with the data protection principles and this policy. Please note that third parties are not covered by our privacy policy and are not subject to our privacy standards and procedures

Severance. If one or more conditions of the general and/or specific terms and conditions are void or invalid, this will not affect the validity of the remaining conditions of the general and/or specific terms and conditions. When the general terms and conditions differ from those determined in the specific terms and conditions applicable to a promotion, the specific terms and conditions for that promotion shall prevail.

Compliance with Law. This promotion and other promotional activities of the Company need to adhere to the [Gambling Act 2005], and any applicable laws of England and Wales, which take precedence over any rule to the contrary herein.

Governing Law. The promotion and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
